The Government of the Republic of Zambia has received financing from the World Bank towards the cost of the Zambia Mining and Environmental Remediation and Improvement Project (ZMERIP) and intends to apply part of the proceeds for consulting services

Assignment Objective
The main objective of this consultancy is to draft operating procedures for the management and administration of the Environment Fund and perform a Regulatory Impact Assessment (RIA) in accordance with the requirements of the Business Regulatory Review Act No. 3 of 2014.:

Scope of Work:
Without limiting the generality of the above, the consulting firm is expected to undertake the following specific tasks:
Fund Management
• Propose the institutional, governance and financial structures for the environment fund;
• Develop a resource mobilization strategy:
• Make recommendations of additional uses and sources of revenue for the Environment Fund;
• Propose options for capitalisation and sustainable resource mobilisation;
• Make recommendations on community involvement and/or participation;
• Propose criteria for remedial site actions for mitigating or restoring environmental degradation;
• Propose appropriate investment management options for the Environment Fund, and
• Provide an enforcement mechanism for the Environment Fund.
Fund Utilisation
• Make recommendations of eligible activities which may benefit from the Environment Fund and provide requisite criteria on eligibility
• Propose appropriate institutional structures and management arrangements for the Environment Fund;
• Benchmark proposed interventions based on international best practices, including interventions from at least 4 examples of environment funds of countries with similar climatic, economic and regulatory status;
• Propose the EF's results framework (inclusive of a monitoring, reporting and verification system linked to the Domestic Measurement Reporting and Verification (MRV) System under development at ZEMA)
• Facilitate stakeholder consultation workshop, and
• Facilitate a stakeholder validation workshop.

Guidelines and Operating Procedures
• Develop operating procedures for site assessments and characterization;
• Develop guidelines on monitoring and/or enforcing the implementation of the Regulations and the procedures applying to the operations;
• In addition to the activities provided for under section 97 of the EMA, identify other activities for which the Environment Fund may be used, and
• Propose contents of Regulations and operating manual providing procedures for regular operations of the environment fund

Regulatory Impact Assessment
• Facilitate a Regulatory Impact Assessment of the proposed Regulations;
• Facilitate stakeholder consultation workshop and/processes; and
• Facilitate a stakeholder validation workshop and/or processes

Duration of the Assignment
This assignment is expected to be completed within a period of 150 working days spread over 5 calendar months after signing of Contract. This assignment is expected to be undertaken around February to June, 2022

Invitation
ZEMA invites interested and eligible consulting firms ("Consultants to indicate their interest in providing the Services. Interested Consulting Firms should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

Eligibility Criteria
The shortlisting criteria includes:
• General experience of the firm(s) in offering Consulting Services;
• Evidence showing the technical expertise of the firm in carrying out similar assignments based on past/historical assignments for at least 2 or more similar assignments in the past 5 years;
• General qualifications and experience of Principals (key staff of the firm such as Directors);
• Experience of working in a similar geographical region, and
• Evidence showing the managerial capabilities of the firm.

The above required relevant qualifications and experience relate to the qualifications and experience of the firm and should not be based on individual experts or biographical data of the firms that express interest as this is not required at this stage.

Attention of Interested Consulting firms is drawn to Section III, paragraph 3.14, 3.16 and 3.17 of the World Bank's "Procurement Regulations for IPF Borrowers" (Version July 2016, Revised November 2017 and August 2018), setting forth the World Banks's Policy on conflict of interest.

Consulting firms may associate with other forms in the form of a Joint Venture or a sub consultancy to enhance their qualifications
A Consulting firm will be selected in accordance with the Selection Based on Consultant's Quality and Cost Based Selection (QCBS) method set out in the Consultant Guidelines
